La presencia del Alto Comisionado de las Naciones Unidas para los Refugiados (ACNUR) data de los años 60, y es en 1979 cuando se establece la Representación de ACNUR en España, en Madrid. Desde el año 2013 Francesca Friz-Prguda es la Representante de ACNUR en España. España se adhirió a la Convención de Ginebra de 1951 sobre el Estatuto de los Refugiados el 22 de julio del año 1978, quedando consagrado el derecho de asilo en el artículo 13.4 de la Constitución española del mismo año.
